It is illegal for a person under 18 to purchase cigarettes products in US. A retailer may ask for photo ID etc to check the age.

Different states may have different rule to allow or not for a person under 18 to consume tobacco products.
California is the second state after Hawaii to have an age requirement of increased from 18 to 21 to purchase tobacco.
